2.5.2 ASBO Guidance Involving Young People |
Following consultation with Police, CPS and Youth Offending Service (YOS) it has been agreed that all agencies will follow the guidelines below when dealing with ASBO applications involving young people.
Contents
1. Police
- There will be early consultation with CPS and YOS by OIC to named YOS contact.
- OIC will prepare MG13 along with MG3 and present this with all available evidence to the Duty Prosecutor when obtaining a charging decision. MG13 to be copied to YOS.
- MG13 will be sent to the CPS with case papers and MG13 must be copied to the YOS if completed after charge.
- CJU will quality assure case papers including ensuring that where ASBO is requested on case papers there has been consultation with YOS and CPS have been made aware.
Officers must not attend court on the day of trial with an ASBO application. You will be turned away.
2. CPS
- Martin Edwards named contact for CPS tel. 0208 884 6422.
- Where there has been no consultation with YOS the CPS will ask for 1 week adjournment in order for this contact to be made.
3. YOS
- Shelley Greene (Operational Manager) and Richard Vaughan (Court Team Manager) to be named contacts at YOS for consultation purposes. Contact number 0208 489 1505
- Will ensure that checks are made re involvement of Children’s Services so that they are consulted and are aware of the application.
- Will inform CPS in writing where they oppose the making of an ASBO giving their reasons.
- Will address the making of an ASBO and recommendations for conditions in Pre Sentence Reports.
- Will train the court team as a matter of urgency
- Will deliver training to magistrates in September along with Inspector Craig Middleton.
- Will report information of any breach of ASBOs to the CJU at Hornsey (PS’s Barry Warboys and Martin Pugh and Jan Strachan)
